7 Common Personal Injury Claims

Frank • February 24, 2022
Did you know that 35 million emergency room visits result from personal injury-related cases? Millions suffer personal injuries each year due to negligent parties. Unfortunately, many people do not know they can file for compensation for personal injuries caused by negligent individuals and medical errors. Explore seven common personal injury claims that you can file.

1. Car Accident Claims

Millions of Americans are injured in car accidents caused by negligent drivers every year. These accidents may be caused by driving under the influence, texting and driving, or overspeeding. For this reason, car accident claims are very common in the United States.

It may be hard to determine who was at fault in some accident cases. Therefore, accident victims must have good legal representation. Drivers found liable in a personal injury lawsuit must pay the victims financial compensation.

2. Wrongful Death

When an individual dies because of another's negligence, the deceased's family may file a wrongful death claim. A wrongful death suit may result from medical malpractice, construction accidents, motor vehicle accidents, airplane crashes, or nursing home neglect. Compensation for a wrongful death claim differs from compensation for non-fatal injuries. New Paragraph

3. Slip and Fall Accident Claims

Slips and falls are another common personal injury claim. If a slip and fall on another person's property results in an injury that costs you financially or results in income loss, you can claim compensation for the accident. However, to win your claim, you should be able to prove that hazardous conditions on the property caused the fall.

4. Workplace Injury Claims

When an employee sustains an injury at their workplace, they can file a compensation claim. According to California workers' compensation laws, if the injured party dies, their dependents are entitled to compensation. Common causes of workplace accidents include unsafe working conditions, faulty equipment, or inadequate training.

Hiring an attorney with experience in workplace injury claims will ensure your rights are protected. A good attorney will also guide you through the entire claim process.

5. Dog Bite Injury Claims

While dogs are beloved pets, they can sometimes pose a danger. Over 4.5 million Americans are bitten by dogs each year, and 1 in 5 among those require medical treatment. In most cases, dog owners are held responsible for dog bite injuries.

The challenge in dog bite injury claims is proving that the owner knew that their dog was dangerous. To do this, you want representation from a personal injury attorney who has handled previous dog bite cases.

6. Product Liability Claims

Defective products can cause consumers serious harm. Incorrect labels and operation manuals can also cause injuries. In such cases, injured parties are entitled to financial compensation. Liable parties in product liability claims include people, companies, or government entities that manufactured, supplied, or sold the product.

Your attorney will evaluate the product in question during a product liability claim and identify the responsible parties. This will help you have a solid case and maximize your compensation.

7. Burn Injury Claim

Burn injuries are painful and traumatic and may be costly to treat. Apart from the pain and treatment costs, burns may result in permanent scars that harm victims' self-confidence. Some common causes of burn injuries include workplace accidents, motor vehicle accidents, construction accidents, and defective products.

You can file a compensation claim if you or a family member has sustained burn injuries due to a negligent party. Before filing the claim, make sure to secure legal representation from a personal injury lawyer to maximize your chances of winning.

A devastating crash in Pomona has left a family grieving after a suspected DUI driver caused a head-on collision that killed three people, including a 1-year-old boy. The tragedy unfolded late Saturday night on the 60 Freeway when a wrong-way driver crashed into a Honda Civic carrying two sisters and the infant. The victims have been identified as 1-year-old Ezra Aziel Espinoza, 29-year-old Jazmin Guadalupe Ramos, and 39-year-old Raquel Moreno. Both women died at the scene, while little Ezra was rushed to Children’s Hospital of Orange County. After showing no signs of life, he was taken off life support on Tuesday, his family confirmed. Authorities say the crash happened just after 11 p.m. near Reservoir Street when a driver, traveling east in the westbound lanes, slammed into the sisters’ vehicle. The California Highway Patrol identified the driver as 24-year-old Rick Rodriguez of Pomona. He suffered only minor injuries and was taken to Pomona Valley Hospital before being arrested on suspicion of driving under the influence. As the victims’ loved ones mourn their loss, family members shared that the sisters’ parents remain in Mexico, unable to be with their grieving relatives in Southern California. A tragic head-on collision in Merced County claimed the lives of a man from Ceres and a child early Saturday morning. According to the California Highway Patrol, the crash happened around 12:19 a.m. on Highway 165, just south of Turner Avenue. Authorities say 20-year-old Melissa Rosales of Los Banos was speeding in a 2014 BMW SUV heading southbound when she failed to properly navigate a curve. Her vehicle crossed into the northbound lane and crashed head-on into a 2016 Honda Accord driven by a 41-year-old man. Both the driver and a juvenile passenger in the Honda were pronounced dead at the scene. Rosales sustained major injuries and was airlifted to a hospital in Modesto. After an investigation, CHP determined she was under the influence of alcohol at the time of the crash. She was arrested for felony DUI and vehicular manslaughter, facing serious charges as a result of the deadly collision.
