Understanding Slip and Fall Accidents: What You Need to Know

May 15, 2024

Slip and fall accidents are a common occurrence that can happen to anyone at any time. Whether it's a wet floor in a grocery store, uneven pavement on a sidewalk, or icy stairs outside a building, these accidents can result in serious injuries.

Read on to learn what exactly constitutes a slip and fall accident, whether you need to hire a personal injury attorney, if you can file a lawsuit for medical costs even if the accident was your fault, what steps to take if you slip and fall on someone else's property, how much time you have to file a case after an incident, and whether or not you can make a claim if you have preexisting conditions.

What Defines A Slip And Fall Injury?

A slip and fall injury or accident is just as it sounds — when a person falls and gets injured on someone else's property. Where a slip and fall accident turns into a legal situation is when a person slips, trips, or falls on someone else's property due to unsafe conditions. This can include slippery floors, uneven surfaces, poor lighting, or obstacles in walkways and the situation results in an injury. These accidents can lead to injuries ranging from minor bruises to broken bones or head trauma. If you have been involved in a slip and fall accident that resulted in injuries (however minor or severe), it is crucial to seek medical attention immediately and document the incident by taking photos of the scene and obtaining witness statements.

Should You Hire A Personal Accident Attorney?

Whether or not you need to hire a personal injury attorney for a slip and fall accident depends on the severity of your injuries and the circumstances surrounding the incident. You also need to have a strong case that proves the situation was caused by negligence or something otherwise preventable. To build a strong case and work towards getting the compensation you need for work, medical, personal, and emotional losses, you should consider hiring a personal injury attorney.

An experienced attorney can help determine who or what entity is liable for your injury and can gather evidence to support your case. These legal professionals also negotiate with insurance companies and any other involved parties on your behalf, representing you in court if your case goes to trial. They can also help calculate damages such as medical expenses, lost wages, pain and suffering, and future medical care related to the accident. You may also be more likely to have a slip and fall case settle out of court if you hire an attorney, which can save you lots of time and money in court and get your compensation to you faster.

What If The Fall May Be Your Fault?

In some cases, individuals may wonder if they can file a lawsuit for medical costs even if the slip and fall was their fault or if they cannot prove that someone else is responsible for their injuries. This is where comparative negligence laws come into play. Under these laws, each party involved in an accident is assigned a percentage of fault based on their actions leading up to the incident. If you were partially at fault for the slip and fall but still sustained injuries due to hazardous conditions on someone else's property, you may still be able to recover damages through legal action, so don't hesitate to hire legal counsel.

How Fast Should You Take Action?

If you slip and fall on someone else's property, it is important to report the incident to the property owner or manager as soon as possible. Make sure they document the incident in writing and obtain a copy for your records. Seek medical attention promptly, even if your injuries seem minor at first, as some symptoms may worsen over time. Keep detailed records of all medical treatments received as well as any expenses incurred due to the accident. The amount of time you have to file a case after a slip and fall accident varies depending on state laws known as statutes of limitations. These laws set deadlines for filing lawsuits after an incident occurs, depending on the jurisdiction. It is crucial not to delay seeking legal advice after an accident, as missing these deadlines could result in losing your right to pursue compensation for your injuries.

Slip and fall accidents can have serious consequences both physically and financially for those involved. Understanding what constitutes these accidents, when to seek legal counsel, how liability is determined based on comparative negligence laws, and what steps to take after slipping or tripping on someone else's property are essential factors in navigating these situations effectively. Being informed about your rights following a slip and fall accident, including how much time you have to file a case based on statutes of limitations, can help ensure that you receive fair compensation for your injuries while holding negligent parties accountable for their actions.

A tragic hit-and-run crash in Sacramento left a woman dead Wednesday night, and police believe intoxication played a role in the accident. Officers with the Sacramento Police Department responded to the scene on North B Street near Dos Rios Street just before 8 p.m., where they found the woman had died from her injuries. Not long after the crash, an officer spotted a truck matching the suspect vehicle’s description and conducted a traffic stop at Fifth and I streets. The driver was detained as part of the investigation. By Thursday, authorities confirmed the arrest of 62-year-old Steve Read of Sacramento. He now faces felony charges for hit-and-run resulting in death and driving under the influence. Police are urging drivers to avoid the area and find alternate routes as the investigation continues. A vehicle plunged off an overpass onto Interstate 5 in Sacramento’s Natomas area on Monday afternoon, leaving the driver in critical condition. The California Highway Patrol responded to the scene around 12:52 p.m., near the offramp for West El Camino Avenue. The crash occurred while Kyman Jeung was driving northbound on I-5, heading home. He said the incident unfolded in what felt like slow motion, with the vehicle and debris falling onto the freeway just seconds ahead of him. Jeung had little time to react as he quickly maneuvered through the debris, including tree parts scattered across the road. Hours after the crash, locals noticed remnants of debris still on the overpass and in nearby tree branches. Sacramento Police confirmed the driver who fell from the overpass was the only person taken to the hospital. West El Camino Avenue was closed temporarily between Gateway Oaks Drive and Azevedo Drive while emergency crews worked at the scene. The road fully reopened around 3:15 p.m. Thankfully, no other drivers were injured, though Jeung expressed how fortunate he and others were that the vehicle didn’t land on them.
